The area of Public Finance Law in Georgia has historically been dominated by a select group of large Atlanta law firms, and there have been (and continue to be) substantial barriers to smaller law firms that seek to participate in public finance work. Nevertheless, the Firm has acquired a significant amount of experience through its involvement with tax exempt and taxable public finance transactions throughout Georgia.
Since 1993, the Firm has served as bond counsel, underwriters’ counsel, or issuer’s counsel for all types of public finance transactions, including governmental financings benefiting political subdivisions such as school districts, counties, and cities, as well as private activity financings benefiting hospitals, colleges and universities, as well as other 501(c)(3) designated entities. In a typical transaction, our Firm begins providing advice to a client at the beginning of the project planning phase and continues providing advice throughout the financing, including providing, as appropriate, election guidance, bond validation, legislation guidance, preparation of closing documents, and ultimately providing an opinion related to the tax treatment of the bonds.
